One Note Now (the "Project") is an artistic project consisting of a collective digital composition. It is conceived and administered by Alessandro Bernardini (acting as a private individual, not as a registered business), hereinafter "the Administrator".
The Project allows participants ("Contributors") to add a single sound event — a note or a breath — to a global, ongoing composition (the "Work"). Each contribution is anonymous and identified only by an internal code.
Participation in the Project requires a one-time contribution. The amount of the contribution depends on the current stage of the Work and is always displayed to the Contributor before the payment is confirmed. The amount comprises a contribution to the Project together with the related payment processing fees. No amount other than the one displayed at the moment of contribution is charged.
The contribution is a voluntary support to an artistic and cultural project. It supports the creation, maintenance, hosting, and long-term sustainability of the Work. It is not a purchase of goods, a subscription, or a recurring payment. No physical or downloadable product is delivered.

Accordingly, contributions are non-refundable. This applies regardless of subjective satisfaction with the resulting sound or with the Work as a whole. If, for a technical reason, the payment succeeds but the sound event cannot be included in the Work, the contribution is refunded in full; the waiver above applies only once inclusion has actually occurred.
By contributing, the Contributor grants to the Administrator a free, non-exclusive, perpetual, irrevocable, worldwide, transferable and sub-licensable licence to use, reproduce, modify, adapt, perform, publicly display, distribute, broadcast, exhibit, publish and include their contribution in the Work, in any medium, format, context or purpose, whether existing now or developed in the future, including but not limited to digital distribution, live performance, exhibition, installation, editorial publication and commercial exploitation of the Work as a whole.
The Work qualifies as a "collective work" within the meaning of Article 3 of Italian Law 633/1941 on Copyright (LDA). Once a contribution is integrated into the Work, it becomes an indivisible part of an artistic whole created and coordinated by the Administrator. In any event, the Work is protected as an original work of authorship created by the Administrator — who conceived its form, its system of rules and the instrument through which every contribution is expressed — and the collection of contributions is further protected as a database of which the Administrator is the maker (Articles 64-quinquies and 102-bis LDA).
The Administrator is the sole holder, curator and manager of the Work as a whole. The Administrator alone holds and exercises all economic exploitation rights on the Work, including but not limited to rights of reproduction, distribution, public performance, broadcasting, adaptation, and commercial exploitation in any present or future form.
The Contributor expressly and irrevocably waives:
Moral rights that are inalienable under Italian copyright law remain with the Contributor. The Contributor acknowledges that contributions appear within the Work anonymously and without individual public credit or attribution (see Section 4.4). The private Code described in Section 5 allows the Contributor to retrieve and recognise their own sound event; it does not entitle them to any form of public attribution within the Work as presented.
Following each contribution, the Contributor receives a unique alphanumeric code (the "Code") that identifies their sound event within the Work and allows retrieval of its parameters and timestamp. The Code is a digital trace of participation. It is not, and shall not be construed as, a financial instrument, a security, an investment, a share or quota, or a guarantee of economic value, present or future. It does not confer ownership of, or any economic right in, the Work.
The Project does not require account creation; the Code is the only means to retrieve the specific moment of inclusion. The Project does not provide a code-recovery service: a lost Code cannot be restored to the Contributor, and its loss does not entitle them to a refund or to a replacement contribution. The Administrator holds all Codes as part of the Work's archive, but not as a means to return a lost Code to a person — participation is anonymous.
By contributing, the Contributor represents that:
The Administrator reserves the right to remove or obscure an echo that is unlawful or contains personal data. This affects only the displayed text: the sound event it accompanies is preserved unaltered within the Work.
The Project is provided on a "best-effort" basis. The Administrator makes no warranty of uninterrupted availability, absence of errors, or perpetual preservation of the Work. The Administrator reserves the right to modify, suspend, or discontinue the Project at any time without notice.
Descriptions of the Work elsewhere on this website — including statements about long-term preservation, future public presentations, or the re-creation of a contribution "from the same numbers, every time" — express the artistic intent and the technical design of the Project. They are aspirational and do not constitute a contractual guarantee of perpetual availability, preservation, or exhibition, all of which remain subject to the "best-effort" basis described above. In particular, re-creation is performed by the audio system of the listener's device and browser, whose rendering may vary in minor, implementation-dependent ways.
To the maximum extent permitted by applicable law, the Administrator shall not be liable for any indirect, incidental, or consequential damage arising from participation in or use of the Project.
These Terms may be updated. The version in force at the time of each contribution is binding for that contribution. The current version number and date are indicated at the top of this document.
These Terms are governed by the laws of Italy. For any dispute, the exclusive jurisdiction is the court of the Contributor's place of residence, where applicable under mandatory consumer protection rules; otherwise, the court of Trieste, Italy.
